1. Acceptance of Terms

By creating an account, downloading, or using the FinoAI application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our Service.

These Terms constitute a legally binding agreement between you ("User", "you") and FinoAI ("we", "our", "us").

2. Description of Service

FinoAI is a personal financial management application that provides:

• Budget creation and tracking with categorized spending
• Income and expense recording and analytics
• Savings goals and progress tracking
• Financial insights and notifications
• Premium subscription features with advanced analytics

FinoAI is not a financial advisor, bank, or payment institution. We provide information and tools to help you manage your personal finances. Any financial decisions are solely your responsibility.

3. Eligibility

• You must be at least 18 years of age to use our Service.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.

4. Account Registration and Security

To use certain features of the Service, you must create an account by providing your name, email address, and a secure password. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password and authentication methods (PIN, biometric, 2FA) secure
• Notify us immediately of any unauthorized access to your account
• Not share your account with any other person

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

5. User Obligations

When using our Service, you agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its servers
• Reverse engineer, decompile, or disassemble the application
• Use automated systems to access the Service without our prior written consent
• Impersonate any person or entity
• Upload malicious code or content

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, software, and design — are owned by FinoAI and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

7. Premium Subscription

• Premium features are available through a paid subscription.
• Subscription fees, billing periods, and features are displayed in the app before purchase.
• Subscriptions auto-renew unless cancelled before the end of the current billing period.
• You can manage your subscription via your App Store (Apple) or Play Store (Google) account.
• Refunds are handled in accordance with the applicable app store's refund policy.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Financial data displayed in the app is for informational purposes only and may not reflect real-time information from your bank.

FinoAI does not provide financial advice. Any budgeting suggestions or insights are automated tools and should not be considered professional financial advice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, FinoAI and its directors, employees, partners, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Financial losses arising from your reliance on information provided by the Service
• Service interruptions or data inaccuracies from third-party providers

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Account Termination

• By you: You may delete your account at any time through the Account & Security settings. All your personal data will be permanently deleted within 30 days.
• By you (deactivation): You may temporarily deactivate your account. Your data will be retained for up to 6 months in case you wish to reactivate.
• By us: We may suspend or terminate your account if you violate these Terms or engage in fraudulent or abusive behavior, with notice where possible.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

For users in the United Kingdom, applicable UK consumer protection laws shall apply where they provide greater protection.

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be submitted to the competent courts of the Netherlands, unless mandatory consumer protection laws require otherwise.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
